Ireland – Construction work for buildings relating to health – 8th Lock Adult Day Services Development – Voluntary Ex Ante Transparency Notice (VEAT)

The Health Service Executive gives notice of its intention to proceed under Article 32(4) of Directive 2014/24/EU following an unsuccessful Restricted Procedure previously published under CFT ID 3587266. Only one tender was received. Negotiations with the tenderer did not result in agreement due to the tenderer’s inability to accept mandatory contractual terms relating to buy-out provisions, step-in rights, termination rights and long-term governance obligations required by the HSE. The tender was determined unsuitable within the meaning of Article 32(4). The essential terms, scope and technical requirements of the contract remain unchanged. The HSE intends to negotiate directly with Ballymore Developments for the delivery and 25-year lease of the proposed Adult Day Services facility at 8th Lock. Estimated total contract value is 4,903,410 EUR over the lease term.
