Oslo University Hospital, Department for Medical Genetics, has signed a contract with Illumina Norway AS for the procurement of a new sequentator, MiSeq in 100. The contract includes 4 options on instruments as well as options for service agreements and servicing. The procurement was first implemented as an open competition. Only one tenderer submitted a tender, but this was considered not acceptable because it did not fulfil the requirements in the competition documents, including the self-declaration. Based on this, the competition was cancelled pursuant to the Public Procurement Regulations (FOA) § 25-4, which allow cancellation when there are justifiable reasons. A new competition with negotiations was held after the cancellation, without a prior notice, in accordance with (FOA) § 13-3 letter a. This is allowed when, in a previous competition, tenders are only received that cannot be accepted. In accordance with the regulations, only the tenderer who participated in the original competition was invited to the negotiations.
