Ireland – Cleaning services – Commercial Cleaning Services for schools and centres under the remit of LMETB.

LMETB intend to award a contract by negotiated procedure without prior publication to ensure it can guarantee continuity of service for the provision of commercial cleaning services in compliance with its obligations under health and safety law.  The current contract has been terminated prematurely and the possibility of implementing a new contract in compliance with full procurement is not possible. It takes at least 9 months to complete an orderly change in cleaning services through a competitive process, when preparation, the tender process and TUPE are considered.    To ensure continuity of service, LMETB intends to utilise EU Public Procurement Directive Art 32.2 negotiated procedure without prior publication in the following case (c) insofar as is strictly necessary where, for reasons of extreme urgency not attributable to the contracting authority and brought about by events unforeseeable by the contracting authority, the time limits specified for the open procedures or restricted procedures or competitive procedures with negotiation cannot be complied with.”
